CONSUMER: Users of the SERVICE, most likely, you
This contract is between Ontology2 (PROVIDER) and users of the Ookaboo API (CONSUMER.) By creating an API Key for access to the Ookaboo API (SERVICE), the CONSUMER agrees to the terms of this contract.
This is a contract between Ontology2 (aka PROVIDER) and users of the Ookaboo API (aka CONSUMER); by creating an API Key, CONSUMER agrees to the terms of this contract.
Contract
- Consumers of the Ookaboo API must respect the copyright terms of images and other media objects from Ookaboo. If the creative commons status of an image is found to be an error, Consumers must remove the image upon request of the provide, the copyright holder, or (in some cases) an individual depicted in an image, or the owner of property depicted in an image.
- If an image is found through the Ookaboo API and embedded on a web page, that web page must contain a link to the picture metadata page on Ookaboo (ex. http://ookaboo.com/o/pictures/picture/30412/Offices_of_the_Ministry_of_F...)
- If images from Ookaboo are used in a medium that does not allow direct linkage to Ookaboo metadata pages, the product must contain a textual reference to Ookaboo and also to all of the rights holders of said images.
- The consumer is responsible for accepting e-mail communications from the provider at the e-mail address provided when registering for an API Key.
- API Keys for the service are not transferable to third parties
- The provider sets rate limits to protect the reliability and availability of the service; the consumer will make no attempt to circumvent rate limits or other rules that apply to the service.
- Consumers are allowed (and encouraged) to retain data from the service for an indefinite time.
- Provider reserves the right to change the terms of this contract at any time and to terminate API access for any consumer that violates this contract. Any consumer that does not accept the terms of this contract may request the termination of their API Key.
- There is no warranty for the service, to the extent permitted by applicable law. The provider provides the service “AS IS” without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality and performance of the serving is with you. Should the service prove defective, you assume all relevant costs.
- In no event unless required by applicable law or agreed to in writing will the provider be liable to you for damages, including any general, special, incidental or consequential damages arising out of the use or inability to use the service. (Including but not limited to loss of data, inaccuracy of data or a failure of the service to operate with other systems), even if provider has been advised of the possibility of such damages.
